GENERAL TERMS AND CONDITIONS

General
Swiss law applies to all transactions. Orders are only binding after written confirmation. Events of force majeure, smog, strikes, lockouts, shortage of raw materials, accidents, transport, production and operational disruptions as well as circumstances that OpenStorage is not responsible for entitle OpenStorage to withdraw from the contract or delay fulfillment. Claims for damages of any kind are excluded in such cases. Any other terms and conditions of purchase of individual customers are only valid if they have been expressly confirmed in writing by OpenStorage. By accepting the order confirmation, the customer agrees to and accepts the General Terms and Cconditions.
Scope of Delivery Obligation
Offers are subject to change and subject to prior sale. The ordered goods are delivered in the usual design and quality. We reserve the right to make technical changes.
Prices
Unless otherwise stated, prices are quoted net ex our warehouse and are subject to change. Invoicing is based on the price valid on the order date, plus value-added tax (VAT) and other statutory charges.
Payment
Unless otherwise agreed, the term of payment is 30 days net. Initial transactions are only carried out against advance payment. Agreements on different terms of payment are possible after a credit check by Creditreform. If the customer falls into arrears, default interest of 8% shall be charged from the due date. If facts become known that indicate financial difficulties on the part of the customer, outstanding invoices shall become due immediately. No WIR will be accepted.
Packaging / Shipping
Unless otherwise agreed, shipment will be made ex warehouse at the expense and the risk of the recipient.
In case of breakage or transport damage, the recipient of the goods must immediately arrange for a factual assessment and record with the transport company. Claims for damages must be made immediately to the shipping institution.
The minimum order value is CHF 500 excluding VAT, advance recycling fees (ARF) and copyright remuneration. For orders below the minimum value of CHF 500, a minimum quantity surcharge of CHF 20 will be levied. The costs for packaging and shipping are not included in the price. Additional costs such as notification and scheduled delivery are also charged separately.
The postage costs are as follows:
Net value > CHF 1000.- carriage paid delivery
Net value < CHF 1000.- Packages up to 30 kg according to postal tariff
Packages weighing 30 kg or more according to the current GU tariff (Tariff for long-distance transport within Switzerland).
Shipments by express post and/or cash on delivery are carried out according to the postal tariff.
Parcels weighing 30 kg or more and general cargo deliveries are charged according to the current GU tariff (Tariff for long-distance transport within Switzerland).
Shipments by postal express and/or cash on delivery are made according to the postal tariff.
Delivery time
Delivery option remains reserved in all cases. Partial delivery will be carried out by OpenStorage upon request. Claims for damages due to non-fulfillment or due to exceeding the agreed delivery date cannot be asserted. Cases of force majeure release OpenStorage in any case from any obligation to meet the delivery date and authorize OpenStorage to withdraw from the contract.
Returns
Returns will only be accepted if an agreement has been made in advance. Any return of products by the customer will be at the customer's expense and risk.
Complaints about defects / Guarantee
Any visible damages or missing quantities must be noted on the confirmation of receipt of the carrier upon delivery of the goods. Notices of defects can only be considered within 8 days of receipt of the delivery. If such a complaint is justified, a replacement delivery will be made after the goods have been returned. Further claims, in particular claims for damage compensation, are excluded. No liability is accepted for damage caused by improper handling. In case of product quality issues, only the value of the product will be replaced. No liability is accepted for any further damage, in particular damage caused by failure to follow the instructions for use or by other improper handling or use of a product. OpenStorage offers a minimum 2-year warranty on new goods. Excluded from the warranty are: batteries, normal performance degradation of rechargeable batteries, and wearing parts. If it is determined that the device has no faults or that the faults are not covered by the warranty, the device will be returned at the customer's expense and risk. Furthermore, a processing compensation can be charged.
Place of performance and jurisdiction
Place of performance is the business headquarters OpenStorage. Juristication is Schwyz. OpenStorage will always strive to resolve any differences with customers amicably and by mutual agreement.
